TERMS AND CONDITIONS FOR ACCOMMODATION AND PACKAGE BOOKINGS

1. INTRODUCTION

1.1 These Terms and Conditions govern all bookings made through Gothia Cup Hotels ("Company",

"we", "us", "our") for:

(a) accommodation-only bookings; and

(b) package bookings comprising accommodation together with flights and/or other travel services.

1.2 By making a booking with us, you confirm that you have read, understood and accepted these

Terms and Conditions on behalf of yourself and all persons included in your booking.

1.3 The lead passenger making the booking confirms that they are at least 18 years of age and have

authority to accept these Terms and Conditions on behalf of all travellers included in the booking.

2. DEFINITIONS

In these Terms and Conditions:

Booking means any reservation made through the Company.

Flexible Booking means a booking designated as refundable in accordance with Clause 7.

Gothia Cup means the annual Gothia Cup football tournament held in Gothenburg, Sweden.

Guest means any traveller named on a Booking.

Hotel means any accommodation booked through the Company.

Lead Passenger means the person making the Booking.

Non-Flexible Booking means a booking designated as non-refundable.

Package means a combination of at least two different travel services for the same trip or holiday

within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018.

Travel Services include accommodation, flights, transfers and any other travel services sold by the

Company.

Supplier means any third party providing Travel Services, including hotels, airlines, transfer providers

and other service providers.

3. BOOKING PROCESS

3.1 All Bookings are subject to availability.

3.2 A Booking request constitutes an offer by you to purchase Travel Services.

3.3 A binding contract will only arise when we issue a written booking confirmation.

3.4 You must provide accurate information when making a Booking, including:

• Full names exactly as shown on passports;
• Dates of birth where required;
• Contact details;
• Passport information where requested.
3.5 Any costs arising from incorrect information supplied by you shall be your responsibility.
3.6 It is your responsibility to check all booking documentation immediately upon receipt and notify
us promptly of any errors.

4. PAYMENT
4.1 Payment terms will be specified during the booking process.
4.2 Unless otherwise stated, full payment is required at the time of booking.
4.3 All prices displayed include VAT where applicable.
4.4 Additional charges imposed by hotels, airlines or local authorities, including tourist taxes,
baggage fees or airport charges, may apply and will be your responsibility unless expressly included
in the Booking price.
4.5 We reserve the right to correct obvious pricing errors before confirming a Booking.

5. ACCOMMODATION BOOKINGS
5.1 Accommodation descriptions and photographs are provided for guidance only.
5.2 Hotel facilities may be altered, unavailable or withdrawn without prior notice by the Hotel.
5.3 Room allocation is determined by the Hotel.
5.4 Special requests cannot be guaranteed and do not form part of the contract.
6. PACKAGE BOOKINGS
6.1 Where your Booking constitutes a Package, the Package Travel and Linked Travel Arrangements
Regulations 2018 will apply.
6.2 We accept responsibility for the proper performance of the Travel Services included in the
Package as required by law.
6.3 We may make minor changes to Package arrangements before departure where reasonably
necessary.
6.4 If we are required to make a significant change to a Package before departure, we will notify you
as soon as reasonably possible and provide the options required by applicable law.
6.5 You may transfer a Package Booking to another person subject to:

(a) reasonable notice being provided;
(b) the replacement traveller meeting all travel requirements; and
(c) payment of any costs imposed by Suppliers.

7. CANCELLATIONS BY YOU
Flexible Bookings
7.1 If you have purchased a Flexible Booking, you may cancel your Booking by providing written
notice no later than 1 May immediately preceding the commencement date of the relevant Gothia
Cup.
7.2 Subject to Clause 7.6, we will refund all monies paid for the Booking.
Non-Flexible Bookings
7.3 Non-Flexible Bookings are non-refundable from the date of confirmation.
Cancellation After the Flexible Booking Deadline
7.4 If you cancel after the deadline set out in Clause 7.1, we may retain all monies paid and/or charge
the full booking price.
Package Bookings
7.5 Where a Package Booking includes flights or other Travel Services, cancellation charges imposed
by Suppliers may apply.
7.6 Any non-refundable airline tickets, supplier fees, administrative costs or other non-recoverable
expenses may be deducted from any refund otherwise payable.
Failure to Travel
7.7 No refunds shall be payable if you fail to travel, arrive late, fail to check in, or otherwise do not
use booked Travel Services.

8. CHANGES REQUESTED BY YOU
8.1 If you request changes after a Booking has been confirmed, we will endeavour to accommodate
the request.
8.2 Any amendment is subject to:
(a) availability;
(b) Supplier approval; and
(c) payment of any additional costs
8.3 Name changes on airline tickets may be prohibited or subject to substantial charges.

9. CANCELLATIONS OR CHANGES BY US
9.1 We may cancel or amend a Booking where:
(a) Travel Services become unavailable;
(b) minimum participation requirements are not met;
(c) a Supplier cancels or materially changes arrangements;
(d) unavoidable and extraordinary circumstances arise.
9.2 Where required by law, we will provide alternative arrangements, refunds or other remedies.
9.3 We shall not be liable for additional expenses incurred by you unless required by applicable law.


10. FLIGHTS
10.1 Flight schedules are determined by airlines and may be altered without notice.
10.2 Flight times shown at the time of booking are estimates only.
10.3 Airlines may substitute aircraft, alter routes or amend schedules.
10.4 It is your responsibility to:
(a) obtain valid passports and visas;
(b) comply with immigration requirements;
(c) meet airline check-in requirements;
(d) comply with airline conditions of carriage.
10.5 We accept no responsibility for denied boarding resulting from your failure to comply with
travel requirements.


11. TRAVEL INSURANCE
11.1 We strongly recommend that all travellers obtain comprehensive travel insurance covering:
• cancellation;
• medical expenses;
• personal belongings;
• travel disruption;
• sporting activities where applicable.
11.2 You are responsible for ensuring that any insurance purchased is suitable for your needs.

12. HOTEL RULES AND CONDUCT
12.1 Guests must comply with all Hotel rules and policies.
12.2 Smoking and vaping are prohibited where designated by the Hotel.
12.3 Guests must not:
(a) cause nuisance or disturbance;
(b) damage Hotel property;
(c) interfere with fire safety equipment;
(d) engage in unlawful behaviour.
12.4 Hotels may require Guests to leave premises for misconduct and no refund will be payable in
such circumstances.


13. DAMAGE
13.1 You are responsible for any damage caused by you or members of your party.
13.2 We reserve the right to recover the cost of repairing damage or replacing property.
13.3 You agree to indemnify us against losses arising from your actions or those of members of your
party.


14. CHILDREN
14.1 Any person under the age of 18 must be accompanied by a parent, guardian or other
responsible adult.
14.2 Additional Hotel-specific age restrictions may apply.


15. LIMITATION OF LIABILITY
15.1 Nothing in these Terms excludes or limits liability for:
(a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation;
(c) any liability which cannot legally be excluded.
15.2 Subject to Clause 15.1, we shall not be liable for:
(a) indirect or consequential losses;
(b) loss of profit or business;
(c) losses arising from actions of third parties not connected with the provision of the Travel Services;
(d) losses resulting from unavoidable and extraordinary circumstances.

15.3 Our liability shall in all cases be limited to the amount paid by you for the relevant Booking
except where applicable law provides otherwise.

16. FORCE MAJEURE
16.1 We shall not be liable for failure to perform our obligations where such failure results from
unavoidable and extraordinary circumstances beyond our reasonable control, including:
• war;
• terrorism;
• civil unrest;
• natural disasters;
• epidemics or pandemics;
• severe weather;
• government restrictions;
• transport disruption.


17. DATA PROTECTION
17.1 We will process personal information in accordance with applicable data protection legislation.
17.2 Our Privacy Policy forms part of these Terms and Conditions and is available on our website.
17.3 By making a Booking, you consent to us sharing relevant information with Suppliers where
necessary to fulfil your Booking.


18. COMPLAINTS
18.1 If you experience any issue during your trip, you must notify the relevant Supplier immediately
and contact us as soon as possible.
18.2 Complaints should be submitted in writing within 28 days of your return.

19. CHANGES TO THESE TERMS
19.1 We may update these Terms and Conditions from time to time.
19.2 The version in force at the time of Booking will apply to that Booking

 

20. SEVERABILITY
20.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions
shall remain in full force and effect.
21. NO WAIVER
21.1 Failure by us to enforce any right shall not constitute a waiver of that right.

 


22. GOVERNING LAW AND JURISDICTION
22.1 These Terms and Conditions and any dispute arising from them shall be governed by the laws of
England and Wales.
22.2 The courts of England and Wales shall have exclusive jurisdiction to hear any dispute arising
from these Terms and Conditions.
